ACGIH Defers Decision on Changes to Mineral Oil TLV  The American Conference of Governmental Industrial Hygienists (ACGIH) said that it has postponed until next year any change to the Threshold Limit Value (TLV) for mineral oil.  James Price, ACGIH’s Director of Science, said that the ACGIH Board of Directors voted to retain the proposal for a time-weighted average TLV (TLV-TWA) for mineral oil on its 2008 Notice of Intended Change (NIC).  [MFM]

Intervening Patents Failed to Maintain Continuity of Disclosure by Incorporation; Grandparent Patent Anticipated and Invalidated Grandchild Patent.

Zenon Environmental, Inc., owns the “319 Patent,” for a water filtration process that uses air to cleanse particulate matter from “relatively large systems for the microfiltration of liquids.” The patented system uses a skein of hollow fiber membranes in the form of a “scrubbing force” of bubbles to filter the “substrate” in order to ensure the free flow of permeate over an extended period of time and thereby reduce the necessity for frequent cleaning.

The 319 Patent is the sixth patent in a series of connected Zenon applications, including the 373 Patent. The 373 Patent is also directed to filtration devices using air bubbles to cleanse the skein for water filtration.

United States Filter Corp. is one of Zenon’s principal competitors in the water filtration industry. Zenon brought an action against US Filter alleging infringement of the 319 Patent. The District Court construed the disputed claim terms in a Markman hearing, then held a bench trial on the validity of the 319 Patent. US Filter argued that the 319 Patent (the “grandchild”) was not entitled to claim priority from the 373 Patent (the “grandparent”) under 35 U.S.C. §120, because the intervening patents failed to incorporate by reference the gas distribution system disclosed in the 373 Patent thus breaking the chain of priority; i.e. each patent in the “family chain” did not support the asserted claims in the 319 Patent.

The District Court held that US Filter failed to prove that the 319 Patent was invalid by clear and convincing evidence, but granted US Filter’s motion for summary judgment of non-infringement. US Filter appealed the patent validity ruling, and Zenon cross-appealed from the entry of summary judgment of non-infringement.

The Federal Circuit reversed, finding the 319 Patent anticipated by the 373 Patent. “In order to gain the benefit of the filing date of an earlier application under 35 U.S.C. §120, each application in the chain leading back to the earlier application must comply with the written description requirement of 35 U.S.C. §112.” Lockwood v. Am. Airlines, Inc., 107 F.3d 1565, 1571 (Fed Cir. 1997). Incorporation by reference provides a method for integrating material from various documents into a host document. The host identifies with detailed particularity what specific material it incorporates and clearly indicates where that material is found in the various documents.

(Wixom, MI, and Bowling Green, Ohio), Herding Filtertechnik (Amberg, Germany), and the Monlan Group (Westlake, Ohio).  In any event, the website is up-to-date and touts the super filtration of Herding permanent media HSL Micro Coat Filter Elements.  The body of the element is formed by a sintered polyethylene PE-matrix.  The filter surface is built by a micro-porous coating embedded into the pores of the PE-matrix.  Dürr Ecoclean, Inc. believes the technology may revolutionize the fine filtration coolant market.  [MFM]

JERRY BYERS' BOOK GOES TO TRIAL  - Just when we were ready to bitch about the lack of MWF information in the recent editions of TLT, the August issue included "Basics of Metalworking Fluids."  Nice, but not nearly enough.  Still, it was enough to convince me to pack my copy of METALWORKING FLUIDS (2nd edition) and take it with me for my jury summons.  I'm an attorney, so I never get picked anyway.  Neither the prosecutor nor the defense counsel wants a bored lawyer in the jury room controlling their case.  Just to be sure, I stacked the deck in my favor by being honest on the juror questionnaire.

METALWORKING FLUIDS: Metallurgy for the Nonmetallurgist.  They picked me anyway.  Unbelievable.  Clearly, I am being punished for being a smart ass.  Sadly, this isn't the first time that's happened.  On the bright side - I really enjoyed the chapter.  Simple and written in a straight-forward style that every real engineer will appreciate.  It's a great refresher for those of us that are five+ years out of school.  Or even (five)x(years) out.  Who knows, I might actually finish the book before I'm asked to render a verdict.
